By accessing or using the Website, you as User ("User", "You") expressly acknowledge and agree that you are entering into the following legal agreement with us (hereinafter the "Terms") and have understood and agree to comply with, and be legally bound by, these Terms, together with the relevant Privacy Policy which can be found on the Website.
If you do not agree to be bound by these Terms, please do not access or use the Website.
1. General Conditions
Banco Oro 9999 specialises in the online sale and insured safekeeping of physical .999 fine gold, as well as the issuance and exchange of digital assets backed by gold (the "digital asset"). Each digital asset represents ownership of a specific gold quantity, identifiable by a unique lot number, bar identifier, serial number, or other inventory method maintained by Banco Oro 9999. Physical gold and gold-backed digital assets may be purchased from the Website in the available quantities (the "Service").
Banco Oro 9999 ensures that all disclosures, price information, and data privacy measures strictly adhere to applicable Swiss laws and regulations governing the trading, storage, and tokenization of precious metals. Digital assets are fully backed by physical gold stored in non-bank vaults managed by Banco Oro, with inventory and segregation in place. Swiss legal requirements mandate transparency, buyer identification for significant transactions, and secure logistics for the gold trade in its physical and tokenised form. All aspects of the Service—from ordering physical gold or digital tokens to custody—are delivered in compliance with Swiss AML/KYC regulations on intermediaries of precious metals.
The website serves as a primary channel for presenting services, offering secure transactions, and facilitating customer engagement. Orders for physical or digital gold assets are subject to the availability posted on the Banco Oro 9999 website. Price, payment, applicable storage fees and insurance fees, tax implications, administration and other costs, are all displayed and available to you in the relevant sections of the Website.
2. Order Placement, Collection, Custody and Tokenisation
When placing an order, we will only execute a purchase after (i) receiving cleared funds in full and (ii) allocating those funds to your account, following any due-diligence checks, if required.
Once the purchase is executed you will be issued a confirmation of product type, weight and serial number. You may choose between collecting physical gold directly at Banco Oro 9999's premises ("Collection"), or authorizing Banco Oro 9999 to hold your gold in insured custody ("Custody"). You may as well choose to buy gold in its tokenised form, receiving a digital asset representing ownership of your purchased quantity of gold ("Tokenisation").
If Collection is chosen, our liability for the safekeeping, loss, or damage of the gold ends upon delivery at the premises. From that moment, you are recognised as the sole custodian and assume full responsibility for the assets, releasing us from any further obligations.
If Custody is selected, we arrange secure storage of the gold in dedicated facilities and we exercise the care of a diligent custodian in storing the physical gold, we keep individualised custody records, segregate your holdings from our eventual own holdings and we conduct reconciliations consistent with industry practices for allocated storage. We provide insurance coverage for the gold until you decide to collect your order.
When opting for Tokenisation, you must specify a digital wallet address where the digital assets representing your gold will be stored. By providing the wallet address, you acknowledge that your wallet is only controlled and accessed by you, and once the digital asset is transferred, you are the sole custodian of the digital gold. Non-custodial tokenisation services equate in responsibility to the Collection of your gold.
When purchasing tokenised gold, you also agree that the corresponding digital assets are not freely transferable but may only be transferred to users whose identity is verified by Banco Oro 9999 and whose wallets have been whitelisted following mandatory KYC procedures.
By submitting an order on the Website, you accept all service terms and, if Custody or Tokenisation is chosen, you further agree to the Custody fees and the digital asset transfer conditions.
You may terminate the Custody at any time by submitting a Collection request. We will acknowledge your request at the first opportunity during our regular business hours and initiate the transfer of your physical gold to our designated Collection facilities. While your request is promptly received, collection can only occur after the necessary processing time required to securely move the gold to the collection location. The gold always remains readily available, as it is neither reinvested, lent, nor otherwise utilized; however, due to the nature of handling precious metals, some delays may occur during transport. Once the gold has arrived at the collection facility, it can be collected during our regular business hours. Please check our Website for more information on opening hours.
